"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.

In her order, the court pointed out that the government lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
